Contract terms

Background

These terms and conditions apply when the customer orders products from the Ninja.fi online store at www.ninja.fi. By placing an order you accept the general terms and conditions. These terms and conditions are without prejudice to the rights of consumers under Finnish law (Consumer Protection Act).

Ninja has the right to suspend the online store if necessary, for example for maintenance.

Ninja reserves the right, for justified reasons, to modify these terms and conditions by giving notice by e-mail, in writing or via the online shop. Orders are subject to the terms and conditions in force at the time of ordering, which the customer must accept before proceeding with the order.

All texts and images on this website are the property of Ninja. Unauthorised use or reproduction of copyrighted images and text is prohibited.

Prices

Product prices are in euros (EUR) and include VAT at the current rate of 25.5%. Prices do not include handling and shipping costs. The prices we quote at the time of ordering are valid throughout the customer's purchase process. Handling and shipping costs will be added to the total amount of the order, broken down according to the delivery method chosen by the customer before the order is confirmed. Ninja reserves the right to cancel an order in case of a clear price error. A clear price error in the online shop means that the price of a product is clearly and significantly different from the correct price of the product (for example, if the product has a price of EUR 0.00 or no price at all). In such a case, the incorrect price is so clearly different from the correct price that the consumer is deemed to understand that the price information is incorrect.

If there is a promotion running in the online shop or if the customer has a promotional code entitling him to a specific benefit in the online shop, the customer cannot use more than one benefit at a time. A customer cannot use a one-off benefit twice. Promotions are valid for a limited period and cannot be combined. Promotional benefits will not be granted retroactively. Promotional benefits are personal and can only be used once, if the customer uses the benefit more than once (for example, by using multiple customer accounts or emails) Ninja has the right to charge the customer for the misused discount or cancel the order. If the benefit is granted retrospectively, the refund costs (0,95-1,95€) will be deducted from the benefit.

Binding nature of the contract

The contract is binding on the parties when Ninja has sent a separate order confirmation to the e-mail address provided by the customer (Order Confirmation). The Confirmation will be issued as soon as Ninja has received the order and payment has been successfully made. An order placed on a Friday, a public holiday or a public holiday will be confirmed no later than 18.00 on the following working day. An order can only be confirmed if Ninja can verify the customer's address.

Ninja reserves the right to refuse an order in individual cases. Ninja does not guarantee the availability of the products in the online shop in all circumstances. All purchases made with a customer ID are considered to be purchases made by the customer. It is therefore important that the customer keeps the customer IDs carefully so that they are not disclosed to third parties.

Delivery

Delivery time and notification of delivery

We always aim to dispatch orders by the next working day at the latest. The delivery time for products in stock is usually around 2-10 working days, depending on the delivery method. For orders placed after 14.00, the delivery time is calculated from the next working day. The delivery time is an estimate. In the event of a significant delay in delivery (more than 14 calendar days after the agreed delivery time), the customer has the right to cancel the transaction. The customer will be informed of the delay within a reasonable time and that the transaction can be cancelled if the delay is substantial. Ninja shall not be liable for any damage caused by exceeding the estimated delivery time. Delivery times may be slightly longer during public holidays (e.g. Christmas or Easter).

Ninja will receive and deliver orders in the order in which they are received by Ninja.

If the customer chooses to collect from a Post Office or PostNord or one of their partners, the customer should check the specific conditions for collection (e.g. required certificates or codes) and the up-to-date collection instructions and requirements with the logistics company of their choice. The customer is responsible for the accuracy of the address and contact details provided. Ninja will deliver the consignments preferably by the cheapest possible delivery method, and reserves the right to change the delivery method. The parcel must be collected within seven (7) days of notification of arrival. An uncollected shipment is not a cancellation and will be charged according to the price list.

When the order is ready for collection, a notification will be sent to the customer. This notification will be sent to the email provided by the customer at the time of ordering. The customer is responsible for the accuracy of the contact details provided. If you have indicated that you wish to collect the order from a Ninja store, the order must be collected in person or by proxy. The order number and a valid form of identification must accompany the order. The order must be picked up within seven (7) days of notification of arrival. An uncollected shipment does not constitute a cancellation and will be charged at the price list.

Delivery method and delivery charges

Residents of Finland may choose from the following delivery methods:

  • Ninja stores
  • Ninja's Ninja stores: the post office, Post Office, Postnord or one of their partners, or a parcel machine.
  • Home delivery by Post or Postnord

Ninja reserves the right to change the delivery method. Please check all current delivery methods and prices on our website under Delivery methods.

Delivery of products

Ninja cannot guarantee product availability in all circumstances. If, exceptionally, a product you have ordered is not available, Ninja will inform the customer and will deliver only those products that are available. Ninja will reimburse the customer for any paid products not delivered.

If, exceptionally, not all the products ordered are immediately available, Ninja reserves the right to deliver immediately the products in stock and to deliver the remaining products at a later date as a separate subsequent delivery.

Orders outside Finland

Orders will only be delivered to addresses in the Member States of the European Union, Norway, Iceland, Switzerland, Albania, Bosnia and Herzegovina, Bulgaria, Croatia, Kosovo, Montenegro, North Macedonia, Serbia and Slovenia, and the subscriber will have access to the country-specific delivery methods of Post and PostNord and their partners in each of these areas.

Payment

In the Ninja.fi online shop, you can pay using several payment service providers:

  • Nordea, Osuuspankki, Danske Bank, Säästöpankki, Oma Säästöpankki, POP Bank, Aktia, Handelsbanken, Ålandsbanken and S-Pankki.
  • Visa, Visa Electron, Mastercard, American Express, Eurocard and Diners Club.
  • Mobile payments.
  • Invoice and instalment services: Klarna, Walley, OP Invoice and Flexibility.
  • Gift cards.

Klarna

Buy now - pay later!

These terms and conditions apply between you and this shop from which you purchase goods, tickets or services when you choose Pay later. 

When you choose Pay Later, we offer you the option to pay on the due date, which is 30 days from the date the goods or tickets are sent or the date the services or digital content are available to you. We will transfer our claim to Klarna Bank AB ("Klarna"). Klarna will send you payment instructions by email, according to which you must pay the purchase directly to Klarna or, if you have opted for automatic payment, we will notify you in good time of future payments, which will be automatically debited on the due date. If you prefer to receive payment instructions by post, please contact Klarna Customer Service after you have made your purchase. Payments

We will charge you a billing fee of €0. If the claim is not paid, Klarna will send a reminder, for which Klarna will charge a reminder fee of € 5.00. If, despite payment reminders, the claim remains unpaid, Klarna may transfer the claim to a collection agency for collection, which may incur collection costs.

Currency exchange

If Klarna performs a currency exchange, we will use the exchange rate in force at the time the products are shipped or the services are activated. You will see the estimated exchange rate at the time of purchase, but it may change if the rate fluctuates between your purchase and the time the products are shipped or services are activated. The exchange rate includes, in addition to the base exchange rate, the exchange margin and Klarna's own exchange rate premium. The base exchange rate is determined by the rates available on the wholesale foreign exchange market on the exchange date or the preceding business day. Where required by law, the official reference rate is used.

Changes in the exchange rate can affect you either positively or negatively in the case of refunds and credits. If you request a partial or full refund after a refund, any differences in the exchange rate are your responsibility.

Credit checks and processing of personal data by Klarna

If you choose Pay later as your payment method, Klarna will assess your creditworthiness. 

Klarna will process your personal data to fulfil its obligations both for the purposes of this Agreement and for other purposes as set out in our Privacy Policy. The Privacy Policy is available here and on our website, and by using Klarna's services you confirm that you have read the Privacy Policy. We process your personal data for purposes such as identifying and analysing your customer relationship, conducting credit assessments, marketing and developing our business. We may also transfer your data to selected parties (such as credit reference agencies) who may be located outside the EU/EEA. Our Privacy Notice provides more information about data sharing, your rights to your data, how to contact us with any questions you may have or to lodge a complaint with the authorities.

Assignment or transfer

You may not assign or transfer your rights or obligations under these Terms to anyone else. We may assign or transfer these Terms or any right or obligation under these Terms to a third party at any time provided that the Terms are not made less favourable to you as a result.

Walley Invoice/Payment

Flexibility and choice - pay in one lump sum or in instalments, at the pace of your choice

Invoice and overdraft give you more time to pay for your online purchases. They allow you to wait for your order to arrive before you pay for it. You can pay all at once with an invoice or in smaller instalments with an overdraft, allowing you to pay the amount that suits you best each month, spread over a period of up to 36 months.

Free payment time with your bill - secure and easy transactions

With an invoice, you always get 45 days interest-free payment time for your online purchases. The long payment period allows you to check your purchase and, if necessary, return it before the invoice is due.

To take advantage of the payment period, you need a positive credit decision, which is easy to apply for at the time of purchase. You can apply for it if you are at least 18 years old and have a Finnish personal identity code and a permanent, official home address in Finland. Your credit history will also be checked in Bisnode Finland Oy's register.

The payment method can be used for purchases up to €5 000.

Once you have received a positive credit decision and confirmed the purchase, you will receive an invoice for your purchase by email. If you wish to pay your invoice in smaller instalments and with a payment period that suits you better (1-36 months), you must enter into a revolving credit agreement with Collector Bank AB by logging in to My Website at my.walley.fi. Upon signing the credit agreement, you will be granted a credit limit which will be available for subsequent purchases in accordance with the credit terms and conditions.

Once you have a valid credit agreement, you will only have to pay the minimum amount indicated on the invoice you receive by the due date, but you may choose to pay a higher amount if you wish. You will then receive a monthly statement by e-mail until the credit is paid in full. If you wish, you can always repay your credit in instalments above the minimum amount indicated on your statement.

Cost of credit and example of credit: Ninja.fi online shop applies promotional conditions, with an interest rate of 19.2% per annum expressed in nominal terms and a monthly fee of €2.95 per month (€3.80 on the first invoice). If the credit limit granted is €1 000 and it is used in full for purchases made in the Ninja.fi online shop and the credit is repaid within 36 months, the annual percentage rate of charge is 28.6%, the total cost of the credit is €403, the total amount to be paid is €1 403 and the number of instalments is 36, under the applicable promotional conditions. Late payments will be subject to the legal reminder and collection charges and interest for the period of delay.

Exchanges and refunds

Products ordered have a 14-day right of withdrawal from the date of receipt of the products. The products must be unused and in good condition for sale. The customer is responsible for the depreciation of the product if the product is returned in a condition other than the original condition. Hygiene products delivered in sealed packages (e.g. earrings, piercing jewellery) are not subject to the right of withdrawal if the seal has been opened (Consumer Protection Act 6: 16§ 5) or the package has otherwise been opened.

Return from Finland

Ninja offers free returns for orders with a price before shipping costs of more than €0.00. The customer is responsible for the return costs of orders with a value of 0,00€.

To take advantage of the free refund, the subscriber must log in to their customer account (account.ninja.fi) and fill in the cancellation form, follow the refund instructions and use the refund code provided by Ninja. The customer must use the same email address to log in as the one used to place the order. The return instructions and return ID will be sent by e-mail after the return notification has been processed. The return can also be brought free of charge to a Ninja office. An automatic confirmation message will be sent upon receipt of the cancellation notification. The customer must return the products within 14 days of receipt of the return instructions.

Returns from abroad

The return costs for international orders are the responsibility of the customer.

The subscriber must log in to their customer account (account.ninja.fi) and fill in the cancellation form. The customer must use the same email address to log in as the one used to place the order. The return instructions and ID will be sent to you by e-mail after the return notification has been processed. An automatic confirmation message will be sent upon receipt of the cancellation request. The customer must return the products within 14 days of receipt of the return instructions.

Points to note for returns 

Additional delivery charges will not be refunded upon return. If, after return, any discounts or promotional conditions in the order are not met, the difference will be charged on return. the original order has exceeded the free delivery limit, but after the return the order value is below the limit, the delivery charges for the chosen delivery method will be charged. according to the price list in force at the time.) Otherwise, returned shipments may be charged the actual shipping cost. The reshipment will be invoiced at the shipping cost according to the current price list. One return per order is free of charge, after which the cost of the return will be charged in accordance with the price list in force.

Uncollected delivery

Uncollected shipments are not considered as returns under the Consumer Protection Act. The actual delivery and return costs for an uncollected shipment will be charged in accordance with the price list in force from time to time. A delivery charge of €3.90 will be applied to orders collected from our stores if the order is not collected within the time limit.

Product advertisements

Ninja is responsible for ensuring that each shipment is carefully checked before it is sent to the customer. If, despite this, the product is defective or incorrect, a complaint must be made immediately to Ninja's customer service (asiakaspalvelu@ninja.fi). If you wish to cancel the transaction, payment will be refunded within 30 days of Ninja's receipt of the faulty product.

Consumer Protection

Ninja complies in all its activities with the Consumer Protection Act and the guidelines and recommendations of the Competition and Consumer Authority.

Dispute resolution

If a dispute concerning a commercial contract cannot be resolved by negotiation between the parties, the consumer may refer the matter to the Consumer Disputes Board. Before referring the matter to the Consumer Disputes Board, the consumer should contact the Consumer Advisory Service of the Registrar's Office (www.kuluttajaneuvonta.fi). Disputes can also be resolved through the EU Consumer Dispute Resolution: (https://consumer-redress.ec.europa.eu/)

Force majeure

Ninja is not liable for delays and damages caused by an obstacle beyond its control, which it could not reasonably have foreseen or the consequences of which it cannot avoid. Force majeure includes industrial action, staff sickness, import and export bans, transport disruptions and pandemics. If the force majeure continues for more than three months, both Ninja and the customer have the right to cancel the orders without any compensation or penalty for delay. Ninja will inform its customers of any delays within a reasonable time.

Data protection and security

Payment in the Ninja.fi online store is made using Paytrail, ShopifyPayments, Vipps MobilePay or Klarna payment services. 

Privacy and cookies

Ninja is responsible for the personal data that the customer provides to Ninja or that Ninja obtains in connection with the customer's order. Ninja will ensure the proper processing and storage of customer data. The data is used for the conclusion and execution of the delivery contract, for targeted marketing activities organised by Ninja, for the collection of payments and for other situations related to the management of the customer relationship. The information contained in Ninja's customer register is not disclosed to third parties, except for activities related to the technical management of the online store (e.g. management of the server or the e-commerce platform). The customer can check the customer data held by Ninja by contacting the customer service department at the following address asiakaspalvelu@ninja.fi.

The store is built on the Shopify platform. The Shopify Network Intelligence feature can collect and combine your customer data (e.g. IP address, device and interaction data) with other merchants and Shopify data to provide advanced services (such as personalization and analytics). Age limit and parental consent

The customer is not considered to be of age (18 years) until he/she reaches this age. If the customer is between 15 and 17 years old, he or she can enter into a contract for ordinary and minor purchases without the consent of the guardian, but the guardian is liable for the costs of the contract. For larger or exceptional purchases, the customer must be of legal age or provide written consent from a guardian.
